Tops shooter Payton Gendron, sues Facebook and Youtube. Says “both made him do it!”
The headline is not accurate; however, why not? At the end of the day, Payton Gendron can argue, similar to the fame-seeking attorneys who are suing social media and gun manufacturers, that the same parties who are being litigated against are responsible for his actions. Consequently, he can assert (like the attorneys) that he should not be held accountable for the dreadful massacre that occurred, and therefore, he should be freed from prison.
I can appreciate the absurdity of the situation, and I am not sabotaging what happened that awful day in May of 2022; however, there is no way that manufacturers who produce a legal product could be held accountable for illegal applications of their permitted product. For a victim to sue a gun manufacturer because their product was used in a murder doesn’t make much sense, and a judge or jury ought to see that and decide against the plaintiff.
The lawyers
Everytown Law, Booner & Booner, Ryder Law, and John Elmore have collectively determined that social media platforms, including Facebook, YouTube, and others, contribute to the radicalization of specific individuals. Hence, these legal professionals contend that corporations should bear responsibility for the repercussions stemming from their conduct. The lawyers are evading accountability and attributing blame to the incorrect party. Blame the person and not the object.
I can blame Ford for my driving
Even though automobiles are designed to resemble race cars and military vehicles, this does not mean that they are responsible for the actions of the people who drive them.
If I were to drive my car through a playground while under the influence of alcohol, the people who were injured as a result of my illegal act would be able to file a lawsuit against Ford. Even though the case against Ford regarding my unlawful use of their product would be weak and unlikely to be successful, the victims could still go ahead and file the lawsuit. Yes, you can still sue Ford, but you almost certainly will lose, and the odds are very good that you will be on the hook for court costs.
Blame McDonald’s for my plump figure
We are aware that the food served at McDonald’s is not the healthiest and that eating fast food does have negative effects on one’s health. However, I should be allowed to sue McDonald’s due to my obesity and high cholesterol. Absurd? Undoubtedly, however, in the United States of America, you can sue almost anyone for almost anything. and that’s a problem.
Avaricious lawyers
The lawyers, in my opinion, are exploiting the vulnerable and desiring a huge payday! Hence, it is unequivocally logical to display concern and anticipate a favorable result. Furthermore, these lawyers are granted substantial amounts of complimentary advertising during media conferences on this tragic event. Each time Mr. Elmore goes in front of the cameras to discuss this event, he gains more notoriety and complimentary advertising—possibly worth thousands. It would be great if a judge could see through his smokescreen and dismiss the lawsuits, but Mr. Elmore knows the game and is currently winning.
In light of this, Payton Gendron should also have the option to argue that Facebook, YouTube, and Reddit are responsible for his extremist actions. He can file a lawsuit, and Gendron should be released from prison if these companies are found liable. I understand what you are thinking, and yes, it is crazy; however, Gendron ought to be allowed to present the exact defense, which is that Facebook and MEAN LLC forced him to do it, and as a result, he is not responsible for his actions.
In my opinion, the attorneys who are suing social media and the manufacturers of firearms are attempting to profit monetarily from a tragedy that has occurred. The events that took place on that day in May of 2022 were atrocious, and no amount of money can bring back loved ones who have been lost.
